A) In accordance with BHW rules and regulations and in accordance with Bermuda Law, you MUST be 18yrs or older to play MAS with Code Red Bermuda.

B) Code Red will not allow anyone under the age of 18 to collect a costume nor will we refund any purchase that is made for a third party under the age of 18ys.

Payment

A) Unless you have paid the full purchase price for your costume by no later than the date given for its collection/delivery, you will not be able to collect it.

B) Please note that all purchases including deposits are NON REFUNDABLE, however Code Red reserves the right to utilize its discretion for this in extreme/rare situation on a case by case basis.

C) In the event you fail to pay for the costume by the required date Code Red shall have the right to resell the costume at the same or at a discounted price without any liability to you.

Costume

A) Code Red shall use all reasonable endeavors in providing a costume that matches the specifications given for collection/delivery at the appointed time. No other specifications, descriptive material, written or oral representation, correspondence or statement, promotional or sales literature shall form part of or be incorporated by reference into these Terms and Conditions.

B) By placing an order, you the customer, are stating your TRUE, CORRECT SIZE. Code Red is NOT LIABLE if you have ordered the wrong size costume.

C) Code Red grants no warranties relating to defects in the design, workmanship or materials of the costume. In particular, there is no warranty regarding use, quality, merchantability, fitness, working, order or condition of the costume except that it will be reasonably fit for the purpose.

D) You must make all necessary arrangements to collect or take possession of your costume at the time and at the place given for collection/delivery. If you fail to do so and, in any event, should you fail to collect the costume by designated last and final collection date for all costumes, you will be deemed to have abandoned the costume and your place in the band.

E) In that event Code Red will have the right to withhold, dispose and or resell the costume (at the same or a discounted price) without any liability to you.

You are required to:

A) Follow and obey all reasonable directions and instructions issued by Code Red Band leaders during the Parade of Bands.

B) Comply with all relevant laws and regulations, health and safety regulations and applicable rules and regulations pertaining to Bermuda Law and BHW rules and regulations.

Exclusions of liability

A) While Code Red takes all reasonable care in the performance of this Agreement we nor BHW are not liable for any personal injury, ailment or loss to you or for any loss or damage to your property which may occur during the Parade of Bands.

B) Playing mas involves exposure to the elements, crowds and loud noise. Participating in this activity has an inherent degree of risk involved and requires you to be in good physical shape and to take proper care. While Code Red takes all precautions and uses our best endeavors to ensure that the band and its activities are enjoyable, accidents do happen. It must be made clear that you participate in the band and its activities at your own risk, and Code Red and BHW excludes to the maximum extent permitted by the law any liability for loss, injury or damage to persons or property which may occur during the Event due to any cause whatsoever beyond our reasonable control.

C) Code Red has no obligation, duty or liability to you in contract, tort, for breach of statutory duty or otherwise beyond that of a duty to exercise reasonable skill and care.

Recordings of the Event

A) You consent to filming and sound recording of the Event as a reveler in the band;

B) You consent to the use of such recording in any Code Red broadcast in any territory in the world (including but not limited to our website publication and all media);

C) You understand and agree that Code Red may alter, adapt or edit any such recordings and market and exploit them at our sole discretion; and

April 7th, 2018 is the final day that you can purchase your costume utilizing the one time full payment option.

• Ladies:  IT IS VERY IMPORTANT THAT YOU KNOW YOUR CORRECT BRA SIZE (34 B, C, D etc) & BOTTOM PIECE (S, M, L etc)
• Ladies: Bottom Piece option (Bikini, boy shorts, etc)
• Men:  Waist Size (in inches)

Yes, the pick up dates will be early enough to provide you with enough time to make any costume alterations if needed.

There will also be a last call date to collect your costume in case you missed the other pick up dates, after which all uncollected costumes will no longer be available.

We have also partnered with Dropping Anchor delivery service to hand deliver your costumes should you not want or can not make any of the costume collection dates. More information will be released about this service shortly.
